Apologies if this is a silly question but the sound that an intake makes

Is this actually compressor surge or flutter that is just more prominent?
My understanding is that it is air that is being pushed out the intake coming off the throttle, shouldn't the DV have taken care of that pressure?

It's not surge. It's just the DV fluttering. You can hear it better with an open intake because the stock filter and box muffle it.

Personal view - I won't put one on. The dump is dramatic enough with my EvoMS. Also, it messes with air flow metering (not sure about the extent, but sounds like un-ideal to me)

As far as I know only certain DV makes that flutter sound. If it bothers you, just fit another type.
